§ 1 Scope, Provider

(1) These Terms and Conditions ("T&C") apply to all contracts between UnserVentures UG (haftungsbeschränkt), Strütweg 11, 75334 Conweiler, hereinafter "Models Crowd", and users of the platform at www.modelscrowd.com.

(2) Models Crowd is a booking platform for models, agencies, and booking clients ("clients"). Models Crowd itself does not provide model services.

§ 2 Contract Formation & Registration

(1) Use of the platform requires a free registration. Model profiles are manually reviewed before activation.

(2) By registering, the user confirms that they are of legal age and that all information provided is accurate and truthful.

§ 3 Booking Models

(1) A client's enquiry to a model constitutes a non-binding offer. A binding contract is only formed when the model confirms the booking via the platform.

(2) The contract for the actual model service is concluded directly between client and model. Models Crowd is not a party to that service contract.

§ 4 Fees & Charges

(1) The fee displayed for a booking is the model's gross fee. A service fee is added on the client side and shown transparently to the client before payment.

(2) Models Crowd retains a platform commission of 5–10 % of the model's fee depending on the model's tier. Payouts to the model are made after receipt of the client's payment via SEPA bank transfer, typically on a weekly basis.

(3) If a client was referred by another model, the referring model receives a referral commission of 5 % of the model's base fee. This commission is funded from the platform fee and does not reduce the performing model's fee.

§ 5 Remuneration & Intermediation

(1) Models Crowd (UnserVentures UG) acts solely as an intermediary between clients and models. It is not itself a party to the model service contract concluded between client and model.

(2) Clients pay an all-inclusive total price per booking. This total price comprises the model's fee plus the intermediation service provided by Models Crowd. The exact composition is shown transparently to the client before payment.

(3) Models are charged a platform fee of 5–10 % of their fee depending on their tier. The payout to the model is the agreed fee less this platform fee.

(4) Payment is handled in escrow via the platform using Stripe. The client's payment is collected first; payout to the model occurs after the shoot has been completed.

(5) The following cancellation schedule applies to confirmed bookings (as a percentage of the agreed fee):

  • free cancellation up to 72 hours before the shoot;
  • 50 % of the fee for cancellation less than 72 hours before the shoot;
  • 100 % of the fee for no-show or cancellation on the day of the shoot.

§ 6 User Obligations

  • Accurate information in the profile; current, original photos.
  • No circumvention of the platform: models and clients who have connected through the platform may not settle subsequent bookings outside the platform in a way that would bypass the commission.
  • No discriminatory, offensive, or unlawful content.

§ 7 Cancellation

If a client cancels a confirmed booking, the following cancellation fees apply (as a percentage of the agreed fee):

  • up to 7 days before the appointment: 25 %
  • 3–6 days before the appointment: 50 %
  • less than 48 hours before the appointment: 100 %

§ 8 Liability

(1) Models Crowd is liable only for intent and gross negligence, as well as for breach of material contractual obligations. In cases of simple negligence, liability is limited to foreseeable, contract-typical damage.

(2) Models Crowd accepts no liability for the content, services, or conduct of users.

§ 9 Term & Termination

Membership may be terminated at any time without giving reasons by deleting the account. Outstanding payment and payout claims remain unaffected.

§ 10 Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Should any individual provisions be invalid, the validity of the remaining provisions shall not be affected.
